Terms of Service

1Who we are

HypeFox (hypefox.app and app.hypefox.app) is run by Proiset Solutions S.R.L., Via Andrea Ronchi 15, 20841 Carate Brianza (MB), Italy, VAT IT14651710965 (“we”, “us”).

These Terms are the agreement between you and us when you use HypeFox. By creating an account you accept them. How we handle your data is explained in our Privacy Policy.

2The service

HypeFox writes, voices and animates short vertical videos from the topics you give it, in the style you pick.

HypeFox is new and growing. Today the app makes videos that you can watch and download. Other features described on our website, like posting to your channels, the weekly plan, replies to comments, reports, approvals on Telegram and the calendar, are on the way and not available yet. We'll tell you when they are. When HypeFox posts for you, you'll also have to follow the rules of each platform.

We may change, improve or remove features. Videos are made in a queue, so they can take a few minutes, sometimes longer, and the service may be slow or unavailable at times, for maintenance or for reasons outside our control.

3Your account

• You must be at least 18 years old.
• Use an email address that is yours and that you can access. Keep your password safe: you're responsible for what happens in your account.
• One account per person. You can use it for your own channels or for your clients' channels.
• If you think someone else is using your account, write to us right away at info@proisetsolutions.com.

4Credits, free trial and plans

• Credits are what you use to make videos. Today a short video costs 25 credits, and a Paper Collage video, which has pictures made by AI, costs 50. The app shows the cost before you request each video.
• Free trial: a new account gets 200 free credits to use within 7 days. After 7 days, unused free credits expire.
• If a video can't be made, its credits come back to your account automatically.
• Paid plans aren't available yet, and nothing is charged today. The prices on our website are indicative. Before paid plans open, we'll update these Terms, and you'll see the price, the credits and the conditions before you buy anything.
• We may change how many credits a video costs. A change never applies to videos you have already requested.
• Credits have no cash value: they can't be exchanged for money or moved to another account.

5Videos made by AI

Scripts, voices, pictures and animations are generated by AI models. They can contain mistakes, inaccurate or outdated facts, strange pictures or pronunciations, or content that resembles other people's work. Videos aren't professional advice, for example medical, legal or financial advice.

• Check every video before you publish it. You decide what to publish, and you're responsible for it.
• Label your videos as AI-generated wherever the platform or the law requires it, for example under the EU AI Act and the rules of YouTube, Instagram and TikTok.
• Don't present AI videos as real footage of real events or real people.

6What you write, and what's not allowed

You're responsible for the topics, notes, project details and links you give us, and you must have the right to use them. Don't use HypeFox to create or spread content that:

• is illegal, or encourages illegal acts;
• is defamatory, harassing, hateful or discriminatory;
• is sexual, or exploits or endangers minors in any way;
• deceives people, like scams, fake news, fake reviews or misleading claims about health, money or politics;
• impersonates real people or brands;
• infringes other people's copyright, trademarks, privacy or image rights;
• contains other people's personal data without a legal basis.

Also don't try to get around credits or limits, access other people's accounts, attack or overload the service, copy or reverse-engineer it, or create accounts or videos with automated tools. You can make videos for your clients, but you can't resell access to HypeFox itself.

We may refuse a video request, remove content, or suspend an account that breaks these rules. We'll tell you why, unless the law doesn't allow it.

7Who owns what

• Your videos are yours to use, for personal and business purposes, on your channels and anywhere else, even after your account ends. Keep in mind that the law may not give copyright to content made by AI, and that similar videos can be made for other users.
• What we put inside the videos (styles, animations, characters, icons, sound effects, voices and fonts) stays ours or our licensors'. You can use it as part of your videos, not on its own.
• HypeFox itself, its software, design and brand, belongs to us.
• What you send us is used only to make your videos and run HypeFox. We won't use your videos to promote HypeFox without asking you first.

8No promise of results

We work to make videos that perform, but we don't promise any number of views, followers, comments, leads or sales, nor that your channels will grow. Results depend on things we don't control, like the platforms' algorithms, your niche, timing and competition. The numbers on our website, like those of our own channel, are examples, not promises.

9Our responsibility

We provide HypeFox as it is and as available, and we do our best to keep it working well. To the extent the law allows, we aren't responsible for indirect losses or lost profits, for the consequences of content you publish, or for decisions of the platforms, like removing a video or an account.

Nothing in these Terms limits our liability for intent or gross negligence, or any other liability that can't be limited by law. If you're a consumer, you keep all the rights the law gives you, including those of the country where you live.

10Ending

• You can stop using HypeFox at any time, and delete your account yourself in Settings → Delete account: it's deleted right away. Deleting your account deletes your videos too: download the ones you want to keep first. Unused credits are lost.
• We can suspend or close an account that seriously or repeatedly breaks these Terms, or when the law requires it. Except in urgent cases, we'll warn you first.
• If we ever shut HypeFox down, we'll tell you at least 30 days before, so you can download your videos.

11Changes to these Terms

We may update these Terms, for example when paid plans start. We'll update the date at the top and tell you about important changes in the app or by email before they apply. If you don't agree with a change, you can delete your account. If you keep using HypeFox after the change applies, the new Terms apply to you.

12Law and disputes

If something goes wrong, write to us first: most problems are solved with an email.

These Terms are governed by Italian law. If you're a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can take a dispute to the courts of the place where you live. In every other case, the courts of Monza, Italy, have jurisdiction.
